However, when there are serious issues and injuries our experience is that you will maximize results with representation. Additionally, there are many pitfalls that can only be avoided with representation. It is initially critical to ascertain all possible avenues of recovery. Many times there may be additional responsible parties that are not immediately apparent to the injured party. Furthermore, often there is more than one insurance company with potential liability. For example, did you know that you may possess a coverage called “medical payment coverage” which is automatically responsible for payment of medical bills up to the policy’s limit without the need to prove any liability on anyone? In addition, in most instances that medical payment coverage is not an offset against, and does not reduce any recovery against the responsible parties’ insurance. Also, if you are injured by a party who has no liability insurance, you most likely have a coverage that will provide for your injuries called “uninsured motorist coverage.” There are many issues that must be correctly addressed to assure that you obtain the maximum benefits of this coverage. In addition, you may have purchased a coverage known as “underinsurance” which may afford you additional relief beyond the responsible parties’ insurance. In that instance, there are usually very specific contractual requirements in your insurance policy that must be met in order to make a claim on the underinsurance. Without representation it will be extremely difficult to meet those requirements and the insurance company is not likely to provide voluntary assistance in that regard. Many times the insurance adjuster will seek to obtain your statement before you are represented and even the most seemingly innocent such statement can pose a significant hardship to your case and provide the insurance company with an unnecessary advantage.
